Terms of Service

1. Who we are

These terms are between you and Funderlytics Ltd, trading as Funderlytics AI, a company registered in England and Wales under company number 15848558, with registered office at 45 Fitzroy Street, London, W1T 6EB. You can contact us at hello@funderlytics.ai.

By booking the Assessment or using this website, you agree to these terms.

2. Definitions

“Assessment” means the AI Hours-Back Assessment: a 45-minute recorded video call followed by a written PDF report, as described in section 3.

“Report” means the written PDF report we deliver after the call.

“you” and “your” mean the business that books the Assessment and the person acting on its behalf.

“we”, “us”, and “our” mean Funderlytics Ltd.

3. The Assessment

The Assessment consists of a 45-minute video call, recorded and transcribed with your agreement, in which we work through your team’s workflows to identify time that could be recovered with AI. Following the call, we produce a written PDF report and deliver it to you by email, normally within 24 hours of the call ending. If we need longer, we will tell you.

The Report sets out where we believe time can be recovered in your business and how. It is a diagnostic, not an implementation: building the systems it recommends is a separate engagement.

4. Price and payment

The Assessment costs £999 plus VAT. Payment is taken at the time of booking via Stripe. Your booking is confirmed once payment has been received. We do not store your card details; they are handled entirely by Stripe.

5. Refund guarantee

If the Assessment does not identify at least 5 hours per week of recoverable time in your business, we will refund your fee in full. This is the only guarantee we offer, and it is the full extent of our obligation if the Assessment does not meet that threshold. To claim it, reply to your report delivery email or contact us at hello@funderlytics.ai.

6. Credit against implementation

If you engage us for an implementation install within 14 days of the date your Report is delivered, the £999 Assessment fee is credited in full against the price of that install. The credit applies once, is not transferable, and has no cash value beyond the refund guarantee in section 5.

7. Your obligations

The quality of the Assessment depends on what you bring to it. You agree to attend the call at the scheduled time, ensure the person attending has a working knowledge of how your team actually operates, and provide accurate and complete information about your workflows, tools, and team. If the information you give us is materially inaccurate, the refund guarantee in section 5 does not apply.

8. Call recording

The Assessment call is recorded and transcribed. The transcript is what we use to produce your Report, so agreement to recording is a condition of the call. We will confirm this with you at the start of the call. If you decline recording, we cannot deliver the Assessment and will refund your fee. Our handling of recordings and transcripts is described in our privacy policy.

9. Rescheduling and cancellation

You can reschedule your call using the link in your Cal.com booking confirmation. Please give us reasonable notice so the slot can be reused. If you need to cancel rather than reschedule, contact us at hello@funderlytics.ai and we will discuss options, including a refund where the call has not yet taken place. If you fail to attend the call without notice, we may ask you to rebook before delivering the Assessment.

We may occasionally need to reschedule a call ourselves. If so, we will give you as much notice as we can and offer alternative times, or a full refund if none work for you.

10. Other services

We also offer AI implementation sprints and ongoing fractional Chief AI Officer retainers. Descriptions of those services on this website are summaries, not offers. Any such engagement is governed by a separate written agreement signed before work begins, and these terms apply to it only to the extent that agreement says so.

11. Intellectual property

Once you have paid in full, we grant you a perpetual, non-exclusive licence to use the Report within your business for your internal purposes. You may share it internally and with your professional advisers, but you may not resell it, publish it, or provide it to a competitor of ours.

Our methods, frameworks, templates, prompts, questionnaires, and know-how used to produce the Report remain our property. Nothing in these terms transfers ownership of them to you. All content on this website is our copyright.

12. Confidentiality

Each of us agrees to keep the other’s confidential information confidential and to use it only for the purposes of the Assessment. For us, that includes what you tell us about your business on the call. For you, that includes our methods and the non-public contents of the Report as they relate to our approach. This obligation does not apply to information that is already public, independently known, or required to be disclosed by law.

We will not name you as a client or describe your business publicly without your prior written agreement.

13. No guarantee of outcomes

The Report reflects our professional judgement based on the information you provide. Beyond the refund guarantee in section 5, we make no promise about the business results you will achieve, including any particular time savings, cost savings, or revenue. Whether and how you act on the Report is your decision and your responsibility.

14. Liability

Our total liability to you arising out of or in connection with the Assessment, whether in contract, tort (including negligence), or otherwise, is limited to the fees you have paid us for the Assessment. We are not liable for loss of profit, loss of revenue, loss of data, or any indirect or consequential loss.

Nothing in these terms excludes or limits any liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.

15. Business customers only

The Assessment and our other services are supplied to businesses, not to consumers. By booking, you confirm you are acting in the course of a business. In plain terms: consumer protection rights, including the 14-day consumer cancellation right for distance contracts, do not apply to this purchase. Your rights to reschedule, cancel, and claim the refund guarantee are as set out in these terms.

16. Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute arising from them.

17. Changes to these terms

We may update these terms from time to time. Changes will be published on this page with a revised date below. The terms in force when you book apply to your Assessment.
